These terms and conditions outline the rules and regulations for the use of WFW Ltd website, and any WFW Ltd products including the WFW Ltd app available on the Apple Store and Google Play.

The following terminology applies to these Terms and Conditions, Privacy Policy and Disclaimer Notice and any or all Agreements: “You” and “Your” refers to you, the person accessing this website and accepting our terms and conditions. “Ourselves”, “We”, “Our” ,”Party”, “Parties”, or “Us”, refers to WFW Ltd. “Party”, “Parties”, or “Us”, refers to both ourselves, or either the person accessing this website or ourselves.

Any use of the above terminology or other words in the singular, plural,
capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to the same.

Unless otherwise stated, Waytrails and WFW Ltd and/or it’s licensors own the intellectual property rights for all material on Waytrails. All intellectual property rights are reserved.

We reserve the right at any time and in its sole discretion to request that you remove all links or any particular link to our Web site. Removal of links from our website

Our APP

Our app is for your guidance only, The WFW Ltd nor Waytrails can accept any responsibility for any loss, injury, misadventure, death, damage or inconvenience by using the suggested routes and you use them at your own risk. We cannot accept any liability for any errors and you should have personal insurance in place.

Disclaimer

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill). Nothing in this disclaimer will:

1. limit or exclude our or your liability for death or personal injury resulting from negligence;
2. limit or exclude our or your liability for fraud or fraudulent misrepresentation;
3. limit any of our or your liabilities in any way that is not permitted under applicable law; or

WFWltd and Waytrails can accept no responsibility for loss, injury, misadventure, death or inconvenience by using the maps provided or whilst walking along the route.

Without prejudice to the generality of the foregoing and insofar as possible under relevant law, we can accept no liability whatsoever for any personal injury or death, or for any financial or other loss or damage, whether suffered directly or indirectly and whether consequential or special, which arises from the use of this website or the use of the route, whether on foot, on a bicycle or using any other means of transport.

Our Shop

Placing an order

We ask all customers to register an account with us, there you will be able to access your purchase history and view your delivery tracking number. Please note we do not hold your card details.  We know you’ll do this anyway but we need to highlight that it is your responsibility to keep your password confidential and WFW Ltd cannot be held responsible if your account is hacked. Payments

We use Stripe as our payment gateway, this means that your card details are processed directly with them and are not held by us or on our site. For full details on how they handle your data please view our Privacy Policy.

Delivery & Charges

Deliveries outside of the UK may be subject to customs or import duties. These charges must be paid by the recipient of the parcel. Unfortunately, we have no control over these charges, and cannot tell you what the cost would be, as these are calculated by Royal Mail.

We use Royal Mail and we aim to ship all orders within 3 working days of the order being placed, cost and expected delivery times are below, please note when Royal Mail hit its seasonal peaks delivery times will take longer.

Uk orders: 2nd Class standard is charged at £1.00 and will usually take 2-3 days
Europe: International standard delivery is charged at £2.00 and will usually take 3-5 working days
Rest of the world: International standard delivery is charged at £2.00 and will usually take 6 – 7 working days

When your order has been dispatched, you will receive a confirmation email from us confirming your parcel is on its way. 

Returns, Refund policy and your right to cancel

Under the distance selling regulations, you have the legal right to cancel your order within 14 working days of receipt of the goods. These terms are the same for both non-sale and sale items.

Please notify us by email app@waytrails.com, within 14 days of receipt of your item(s), of your intention to return any.

Please wait for us to reply (usually within 2 days) before sending items back.
Items should be received by us within 14 days of your notification to return.

All goods for refund must be returned in the original packaging with all labels and packaging intact and in ‘fit for re-sale’ condition.

All items must be returned using Recorded Delivery or a fully tracked shipping service.

We do not have a free returns service and you are responsible for the cost of your return.

Original delivery charges and return postage costs will only be refunded if your order was received damaged (you will be required to retain all the packaging to enable us to claim against the delivery company) was incorrectly supplied, has a fault or is covered under the terms and conditions of a specific product guarantee.

Original delivery charges and return postage costs will NOT be refunded if your order is simply unwanted or unsuitable.

We will process refunds as quickly as possible and within 14 days of receiving your returned item(s).

Intellectual Property

All content on this website and the WFW Ltd (Waytrails) app including but not limited to text, routes, posts, logos, marks, graphics, files, materials, services, products, videos, audio, applications, computer code, designs, downloads and all other information here (collectively, the “Content”) is owned by WFW Ltd and is protected by copyright, trademark and other intellectual property laws.

You agree not to copy, duplicate, steal, modify, publish, display, distribute, reproduce, store, transmit, post, create derivative works, reverse engineer, sell, rent or license any part of the Content in any way to anyone, without our prior written consent.  You agree to abide by the copyright, trademark laws and intellectual property rights and shall be solely responsible for any violations of these terms and conditions.

Additional note;

Waytrails hike and bike routes featured in the WFW Ltd (Waytrails) app have been tested, plotted and created by the WFW Ltd and as a result are solely the property of WFW Ltd and must not be copied, shared, or uploaded to any other platform for public display without prior permission.

LIMITATION OF LIABILITY

You agree that under no circumstances, we as the WFW Ltd and/or our officers, employees, successors, shareholders, joint venture partners or anyone else working with us shall be liable for any direct, indirect, incidental, consequential, equitable, special, punitive, exemplary or any other damages resulting from your use of this website or the app including but not limited to all the content, information, products, services and graphics presented here.

You expressly agree that your use of the website and the app is at your sole risk and that you are solely responsible for the accuracy of the personal and any information you provide, the outcome of your actions, personal and business results, and for all other use in connection with the website and the app.

Disclaimer

All forms of outdoor recreation have a higher level of risk than most ordinary activities, and therefore can be potentially hazardous and/or dangerous. This includes hiking and biking and especially off-trail adventure hiking and biking. Risk is always a factor in hiking and biking and off-trail adventure hiking and biking, especially when weather is adverse or unpredictable, or when unforeseen events or conditions create a hazardous condition. There are many risks, both natural and/or man-made, that could lead to injury or death while hiking or biking, especially while off-trail adventure hiking or biking.

For these reasons, it is the responsibility of the users of the website and app to learn the necessary skills for safe hiking, biking and off-trail adventure hiking, biking. Please note that the included GPS trails are also provided only as general guides, and you should not rely on their accuracy 100%, as GPS readings are subject to error and may provide inaccurate directions.

WFW Ltd, (Waytrails) its sponsors, its advertisers, investors, and/or anyone contributing information to this site shall not be held liable for any inconvenience, accidents, rescues, injuries or loss of life should you undertake any of the hikes or bikes listed on this website or in the app.
